Article 11 Liability and Damage

1. Before making a claim, you must consult with 2FitHorses to seek a solution. 
2. In the case of intent, gross negligence or deliberate recklessness on the part of 2FitHorses, 2FitHorses is always liable.
3. 2FitHorses cannot be held liable:

• For the fact that you provided incorrect or incomplete information;
• Due to your acts or omissions;
• If you yourself have departed from the advice or perspectives presented and/or you have not complied with the conditions or requirements, in the broadest sense of the word;
• For oral advice, statements, etc. that have not been put in writing; 
• Shortcomings of third parties engaged;
• Force majeure situations. 

4. If you are an organisation, liability is limited to the following. Liability is limited to the invoice value. Furthermore, 2FitHorses is only liable for demonstrable, attributable and direct loss or damage. All liability of 2FitHorses for consequential loss or damage, lost profit, missed savings, mutilated or lost data or materials, or loss or damage due to business interruption is excluded.
